EUGENE MELNYK RECEIVES COURT APPROVAL TO PURCHASE THE OTTAWA SENATORS OTTAWA - Capital Sports & Entertainment Inc., owned by Eugene Melnyk, today received court approval to purchase the Ottawa Senators Hockey Club. The purchase agreement was presented to the court by PricewaterhouseCoopers Inc., the court-appointed monitor of the Ottawa Senators.
The court, the monitor, the Club, and the secured creditors have approved the agreement. As well, the court has issued an order transferring the Club’s assets to Capital Sports on closing. Capital Sports has the right to withdraw from the transaction if it is not successful in purchasing the Corel Centre.
“It has been a long process, but today’s decision by the court is a very important step forward,” said Mr. Melnyk. “I believe the economics of a financial deal with Covanta Energy Corporation have also been completed. Lawyers are now in the advanced stages of completing the transaction for me to purchase the Corel Centre. Finally, we can now focus on cheering the Senators on the road to the Stanley Cup.”
Mr. Melnyk expects the transactions for both the Ottawa Senators Hockey Club and the Corel Centre to be concluded well in advance of the May 30th deadline. Completion of the transaction to purchase the Ottawa Senators is subject to approval by the NHL Board of Governors. In the interim, Capital Sports has provided a deposit of $7.5 million.
Mr. Melnyk, 43, is chairman and chief executive officer of Biovail Corporation. Biovail is an international, full-service pharmaceutical company with its global headquarters based in Mississauga, Ontario.
“The court process is moving forward, and we anticipate a successful resolution which will give the franchise the stability it needs - a development that is great for the fans,” NHL commissioner Gary Bettman said. “We are delighted Mr. Melnyk has stepped forward, and we will move forward with the Board of Governors’ approval process as quickly as possible.”
MEDIA AVAILABILITY ON SATURDAY: Mr. Melnyk will hold a media availability in the Coliseum Room at the Corel Centre on Saturday, from 3 p.m. to 3:20 p.m. He will also stay for the first period of the Senators’ game, and then has to leave for a previously scheduled charity engagement to support Help Us Help the Children, a project of the Children of Chornobyl Canadian Fund. If you do not have an accreditation for the game, you must contact Senators’ communications staff.
